This story is heartbreaking and I can't imagine a person claiming otherwise. In my opinion Tess is not guilty, because she didn't want any of this to happen and tried to make the right choices. Even the revenge on D'Urberville is justified as all her misery began because of him and I don't think she deserved a death penalty.
