Every state entitled to become a party to the treaty shall also be entitled to become a party
to the treaty as amended.
The amending agreement does not bind any state already a party to the treaty which does
not want to make a party to the amending agreement.
States that become parties of the treaty after the entry into force of the amending
agreement shall be considered parties to the treaty as amended and parties to the
unamended treaty in relation to any party to the treaty not bound by the amending
agreement.
Multilateral treaties, amending between certain parties only:
They may conclude an agreement to modify the treaty between themselves if the
possibility is provided in the treaty or the modification is not prohibited in the treaty (and
does not affect the enjoyment of other parties of their rights and performance of their
