6 Art 5(1)(f) - Bozano v France (1987) CASE OF BOZANO v. FRANCE (18 December 1986) The applicant, an Italian national, was tried in absentia by an Italian court for abduction and murder and sentenced to life imprisonment. Three years later, he was arrested in France by the police, but a formal request for extradition was refused by the Limoges Court of Appeal as the conviction in absentia was incompatible with French public policy. The applicant remained in residence in the Limoges area awaiting trial by the French courts for other offences. On the day that an order was made committing him for trial, the applicant was abducted by French policemen, served with a deportation order (which was over one month old) and forcibly taken to the Swiss border where he was handed to the Swiss authorities. Comparative law

law modeled after the Roman legal system created centuries ago In a common law system, the law is created by precedents set after judges decide actual cases. When a judge hears a case that has a new issue in it, the judge makes a decision regarding the issue in the case. That decision then becomes a precedent that must be followed by other courts with equal standing within the legal system. The precedent remains law unless and until a higher court overturns the decision. The practice of following decisions made by other courts for similar issues is known as stare decisis. In stark contrast to the concept of stare decisis and precedent found in a common law system, decisions in a civil law system are to be made based on a corresponding statute, in theory. In a civil law system, the legislative or executive branch makes the laws and courts are simply required to follow the laws as they have been written.

EU internal Market law. Mid term evaluation assignment

Accordingly, infringements of Article 34 TFEU seem to presuppose activity on the part of a state. In this sense, the measures falling within the scope of Articles 34-35 TFEU consist primarily of binding provisions of Member States’ legislation. Can this measure be attributed to a public authority? Yes. The law was adopted by the Parliament and has the binding power. Is the measure restrictive in the sense of Dassonville formula? Yes. In Dassonville judgment, the Court of Justice took the view that „all trading rules enacted by Member States which are capable of hindering, directly or indirectly, actually, or potentially, intra- Community trade is to be considered as measures having an effect equivalent to quantitative restrictions” (Cases 8/74 of 11 July 1974 and points 63 to 67 of Case C-320/03 of 15 November 2005). Judicial system and its functionality The Syrian legal system is based partly on French law and partly on Syrian statutes. Investigating magistrates determine whether a case should be sent to trial. Minor infringements are handled by peace courts, more serious cases go to courts of first instance. There are civil and criminal appeals courts, the highest being the Court of Cassation. Separate state security courts have jurisdiction over activities affecting the security of the government. In addition, Shari'ah courts apply Islamic law in cases involving personal status. The Druze and non- Muslim communities have their own religious courts. Should mercy killing be punished?

Should mercy-killing be punished? It is argued whether mercy-killing should be punished or not. Every human being deserves the right to life, but is it still so when it is not possible to live a normal life? To start with, it is not life when it is not possible to move or even talk. If a person is in coma and court and his family has given the permission, then mercy-killing should be acceptable. On the other hand, we all make mistakes including doctors. When the doctor says that she or he will never wake up it can never be 100% true. In other words, the doctor should pay his price for taking human life. To sum up, in author’s opinion mercy-killing should not be punished. If it is certified by court, his doctor and family then it is legal and maybe it will be a favor for all of them.

one or some combination of various legal devices. The two most popular are will and living trusts. Wills A will, the simplest estate planning device to prepare, is a document that leaves some or all your property to beneficiaries you choose. You can also use a will to name an adult guardian for your young childrens. The principal drawback of a will is that it must normally go through probate, a complicated and expensive court proceeding. Living Trusts A living trust is a legal document similar to a will in function, exept that no probate or other court proceedings are required to turn property over to beneficiaries. Because of this, living trusts are the most popular probate- avoidance device. Beneficiaries Direct beneficiaries come in two types: · Primary beneficiaries- people or institutions named to receive specially identified property.

A year later the premises was transferred to the Ministry of the Environment and thus the historical territory of the Seaplane Harbour was halved. On December 14th, 1994, the MoD unilaterally assumed the hangars and piers No 38 and 39 as well as other structures (Küti 17). However, the repossession was only formal and lead to prolonged court proceedings. On June 4th, 1996, the premises on Küti 17 and 17A were transferred by a government order under the jurisdiction of the Ministry of Justice which revealed a serious conflict between the authorities and illegal private possessors. On November 14th, 1997, the Ministry of Justice filed a suit with the Tallinn City Court with the request to confirm the state as the legal owner of the premises located at Küti 17 and 17A and retrieve them from illegal possessors

Michael Jordan

He was a scoring machine. The Bulls were not one of the NBA’s better teams, but they gradually improved. They made the NBA playoffs in their first five seasons with Jordan. However, they failed to make the NBA championship finals. In 1989, Phil Jackson became the Bulls’ head coach. Under Jackson, Jordan became more of a team player, although he remained the NBA’s leading scorer. Jordan developed an incredible “court sense.” He knew where every player was on the basketball court, and what was the best play for the circumstances. In the 1990-1991 season, the Bulls won their first of three straight NBA championships. In 1993, Jordan retired from basketball. He tried to make it in professional baseball, but he had little success. He rejoined the Bulls in 1995. In the 1995- 1996 season, the Bulls started another run of three straight championships. Jordan retired for a second time in 1998. He became part owner of the NBA’s Washington Wizards

world, Lebron James. At that time it was eight times the budget, which was approved by the Estonian Government. So it was a heavy sum to pay. In Britain I think they can only blame themselves. You see, unlike many other nations, the UK has no single core constitutional document. In this sense, it is said not to have a written constitution, but much of the British constitution is embodied in written documents, within statues, court judgments and treaties. So in my opinion that's a stupid system. Because if you watch other countries how much do they pay for compensation claims then it's nothing. Though in other countries there are huge sums what civilians get from companies. A former female police officer was awarded an estimated £1,000,000 in a package, after complaining of bullying and sexual and racial harassment. For instance I think it's absolutely ridiculous to get a million for that

that empire (Blefuscu/France)". This partially reflects the exile of King Charles II on the Continent (in France, Germany, the Spanish Netherlands, and the Dutch Republic) from 1651 to 1660, but more particularly the exile of the Catholic King James II from 16881701. James II was dead by the time Swift wrote Gulliver's Travels, but his heir James Francis Edward Stuart, also Catholic, maintained his pretensions to the British throne from a court in France (primarily at SaintGermainenLaye) until 1717, and both Jameses were regarded as a serious threat to the stability of the British monarchy until the end of the reign of George II. The court of the Pretender attracted those Jacobites, and their Tory sympathizers, whose political activity precluded them staying safely in Great Britain; notable among them was Swift's friend, the Anglican Bishop of Rochester Francis Atterbury, who was exiled to France in 1722.
