Antoine Berman ,,Translation and the Trial of the foreign" Resümee Läbiv teema Antoine Berman´i essees on "tõlkimine kui võõra proovilepanek" (comme épreuve de l´étranger), kuid mõlema, nii lähte- kui sihtkultuuri proovilepanek tõlkimisprotsessi käigus. Räägitakse sellest, kuidas tõlkimine on üha enam võõrapärase edasiandmiselt liikumas teksti ,,kodustamise" suunas. Bermani väitel peab iga tõlge tähendama küll teksti mingil määral kodustamist, ent peaks seejuures siiski säilitama oma võõrapärasuse ja sellest tulenevalt ka teatava komplekssuse. Bermani hinnangul kaasneb teksti liigse kodustamisega ka soovimatu lihtsustamine, mis paratamatult kulmineerub sellega, et originaal kaotab oma isikupära. CASE OF BOZANO v. FRANCE (18 December 1986) The applicant, an Italian national, was tried in absentia by an Italian court for abduction and murder and sentenced to life imprisonment. Three years later, he was arrested in France by the police, but a formal request for extradition was refused by the Limoges Court of Appeal as the conviction in absentia was incompatible with French public policy. The applicant remained in residence in the Limoges area awaiting trial by the French courts for other offences. If there is not 9 enough evidence to make a solid accusation, this cannot lead to conviction. The extorting of a confession or manipulating research data can not change this. The right to remain silent and the right of representation also find their grounds in the prohibition of self-incrimination. These rights are at the base of a fair trial. A fair trial can be seen as an objective establishment of truth. Doing this by means of forcing confessions cannot be seen as objectively valid and can thus not be considered as evidence in a fair trial. How much importance utilitarians would see in this is disputable, as by stating that torture is acceptable in certain circumstances, they also could argue an unfair trial is acceptable in certain circumstances. Nathan Radley eventually fills the knothole with cement. Atticus agrees despite Maycomb's racist white community, to defend a black man named Tom Robinson, who has been accused of raping a white woman. Because of Atticus's decision, Jem and Scout are ejected from other children, even when they celebrate Christmas. Calpurnia, the Finches' black cook, takes them to the local black church, with the warm community. At the trial Atticus points out clear evidence that the accusers, Mayella Ewell and her father, Bob are lying. Proof marterial are the marks on Mayella's face from her fathers beating. Mayella also claimed in court that Tom was only needed to save his father from dishonour. Despite the remarkable evidence showing Tom's innocence, the all- white jury convicts him. The value of things VS the price of things

to be shared and used wisely. Value doesn’t have to be always pricey, mean something or be a part of some kind of a memory, normal things daily can have a value, a car is an example. People need it to drive to work everyday in their normal lives, plates have some value, knifes, forks. Just because people aren't willing to directly pay cash for something does not necessarily mean they don't "find value" in it. For instance, when was the last time you personally chipped in for a clinical trial? And how are you paying for that air you're breathing right now? Some benefits are assumed to be part of the environment in which we exist. That's what it means to have an environment. If a benefit grows scarce to the point that people feel they must directly pay cash from their pocket to keep getting it, there's probably a far more dire calamity at hand than that single point of scarcity. Most people will almost always seek other free sources of a benefit first.

Neist valisin välja 3, mis sobisid kõige paremini minu püstitatud probleemiga. Esimeses uuringus1 uuriti konkreetse ravimi (Zolpidem) efektiivsust unetuse ravimisel Jaapani unetutel. Uuringutüübiks oli platseebo-kontrollitud, randomiseeritud, ristikatse. Uuringualuseid oli 17. Efektiivsust hinnati CAP-markeriga (Cyclic Aletnative Pattern), mis peegeldab une stabiilsust.
