Sissejuhatus Common law' mõistet võib kasutada erinevates tähendustes. Selle lai tähendus hõlmab kõigigis Anglo ­ Ameerika maades eksisteerivat õigusnormide, tavade, juriidiliste protseduuride ja pretsedentide kogumit.1 Kitsamas môttes aga kujutab common law endast üldise ôiguse ja ôiglase ôiguse normide kogumit, mis on loodud kohtute ôigusmôistmise käigus ja nende poolt rakendatavat tavaôigust.
